The explosive testimony of Caleb Flynn’s former mistress may have handed Ohio prosecutors a critical piece of their murder case against the former “American Idol” contestant – a potential answer to why he would allegedly kill his wife, a former prosecutor told Fox News Digital.
“Motive. She provides a motive,” Josh Ritter, a former prosecutor, criminal defense attorney and Fox News contributor, said of Alleigha Botner’s testimony. “She gives jurors a reason for why would this man murder his wife.”
“She seems like she was, by all accounts, a very nice woman,” Ritter said about Ashley Flynn. “She’s the mother of his children. Yes, he wanted out of the marriage.”
“Perhaps there was some financial gain in the idea of life insurance, but, you know, jurors oftentimes struggle with that question,” he added.

Flynn is accused of fatally shooting his wife in the back of the head inside their Ohio home on Feb. 16 and staging the scene to look like an intruder had broken in. He has pleaded not guilty to aggravated murder and other charges.
Botner, who testified she carried on an affair with Flynn for roughly a year and a half, spent two days walking jurors through many of the 107,000-plus messages exchanged during their relationship.
Some contained explicit discussions about Ashley’s death.
In one May 2025 message, Flynn allegedly wrote, “If I could literally kill her and not go to hell, I would do it in a heartbeat.”

Days later, he allegedly wrote, “I hate her, loathe her. I want her dead.”
In June, Flynn allegedly told Botner, “Please hire someone to take [her] out. I need you in my life, I need you.”
Botner responded, “So tempting. I can’t live without you. And I’ve had this thought so often lately. How do we figure this out?”
Botner also became emotional while reading one of her own messages to Flynn, expressing regrets that she wished she never wrote it.

“I want to kill her, Caleb,” she had written.
“That makes two of us,” Flynn allegedly responded.
Ritter said it is the substance of those exchanges – rather than simply the existence of the affair or sheer volume of messages – that could prove significant for prosecutors.
“It’s the idea that he’s even discussing her being dead,” Ritter said. “He went as far as to saying I literally would kill her. That’s far beyond someone voicing their frustrations and venting to a lover that I wish my wife wasn’t around, I wish she would leave, I wish we could get a divorce.”
“This is saying you want that person dead, that, in your view, that is your solution to the problem that you have,” he added.
The messages grew particularly significant as prosecutors moved jurors closer to the night Ashley was killed.

Botner testified that Flynn told her in an August message he had stayed up until 4 a.m. “literally thinking of ways to kill her and not go to jail.”
Months later, Botner gave Flynn a Jan. 11 ultimatum to leave Ashley or she would end their relationship. When he failed to do so, Botner cut off communication until Feb. 14 – just two days before Ashley’s death.
By the night of Feb. 15, the two were communicating again.
Botner testified that Flynn discussed his plans for the following day, including telling family members about the divorce and obtaining a burner phone.
Shortly after midnight, Flynn allegedly wrote to Botner, “It’s happening.”
He then wrote, “February 16th – day I’ll never forget.”
“You’re about to be free,” Botner responded.
“I choose you,” Flynn replied.
Those were some of the final messages Flynn sent Botner before she learned Ashley had been killed, she testified.
Ritter pointed to that timing as among the most significant evidence Botner brought to the prosecution’s case.
He noted that Flynn had spent months allegedly talking about wanting Ashley dead before the messages reached the eve of her killing.
“The day before the murder takes place, he tells his mistress that tomorrow is going to be a big day, that he chooses her,” Ritter explained. “He’s made a decision and that tomorrow, meaning February 16th, the date his wife was murdered, will be a day that he will never forget.”
But Ritter said the same enormous volume of messages prosecutors are using against Flynn also gives his attorneys an argument.
The defense can contend prosecutors have cherry-picked the most damaging statements from more than 100,000 messages exchanged during an intense affair and stripped them of the broader context of two people using exaggerated and sometimes ugly language.
Flynn’s attorneys can also argue that when he talked about what would happen Feb. 16, he was referring to finally leaving Ashley – not killing her.

“That could be true,” Ritter said. “It could be that he is just the unluckiest man on earth, that the day he tells his mistress he’s going to announce to his wife that he’s leaving her after months of saying that he wants her dead, that some random home burglar happens to break in with no signs of forced entry, goes to his vehicle, knows exactly where to find his handgun, marches upstairs, puts two bullets in the back of his wife’s head while she’s sleeping, and leaves the rest of the house undisturbed.”
During cross-examination Thursday, Flynn’s attorneys began putting Botner’s own language before the jury.

“I’m so done with you. You have murdered my heart,” Botner acknowledged writing Flynn during one argument. “I hope you’re glad you took my virginity and also my heart and stomped all over it. Enjoy your marriage. I’m done.”
The defense also has another potentially important distinction to emphasize, Ritter said. Despite Flynn’s repeated statements about wanting Ashley dead, he never explicitly told Botner he intended to carry out her killing.
“There was never an explicit mention of, ‘I’m going to do it, I’m gonna follow through on it,'” Ritter said.

“I think they are also going to concentrate on the idea, as they have since opening statements, that this might have been a rush to judgment, that once police uncovered the affair, they stopped their investigation,” Ritter said. “And once they knew that he was planning on leaving his wife, they thought, ‘Well, that’s enough for us. We’re not going to pursue other leads.'”

“I’m not saying that’s a convincing argument, but I’m saying that that is at least something for them to stand on and mount a defense on his behalf,” he added.

The defense can also point to the absence of the alleged murder weapon, an eyewitness to the shooting and gunshot residue on Flynn.
Botner testified, however, that Flynn had previously shown her a gun he kept inside the center console of his truck, though she could not remember what it looked like.

“In an ideal world, would the prosecution want the murder weapon? Sure,” Ritter said. “But … it’s something that the defense is obviously going to lean into.”
But for Ritter, Botner’s testimony ultimately comes back to the question prosecutors hope jurors will ask when they consider the killing – why?
“Motive,” Ritter said. “She provides motive.”
